Workplace Harassment can manifest in numerous ways

 

Verbal Harassment: This includes offensive comments, jokes, or insults related to race, gender, sexual orientation, disability, or other personal characteristics.

 Physical Harassment: Unwanted physical contact, including touching, pushing, or assault, falls under this category. Even subtle gestures can be deemed inappropriate if they make someone uncomfortable.

 Sexual Harassment: A specific form of harassment that involves unwanted sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature. According to the research paper done by (Williams, 1999) Flirting, bantering, and other sexual interactions are commonplace in work organizations. Not all of these interactions constitute harassment or assault; consensual sexual relationships, defined as those reflecting positive and autonomous expressions of workers' sexual desire, are also prevalent in the workplace.

Bullying: This involves repeated aggressive behavior that may include threats, intimidation, or undermining a colleague's work. While not always illegal, it can significantly affect mental health and job performance.

 Cyber Harassment: With the rise of remote work and digital communication, harassment can also occur online, whether through emails, messaging platforms, or social media. (Pittaro, 2007) state in his article that “The Internet has literally become a fertile breeding ground for an entirely new and unique type of criminal offender hereafter known as the cyber stalker. The cyber stalker is one who uses the Internet as a weapon or tool”



Legal Framework

In many countries, workplace harassment is illegal under various laws that protect employees from discrimination and ensure a safe working environment. In the United States, for example, the Equal Employment Opportunity Commission (EEOC) enforces federal laws that prohibit job discrimination and harassment. Employees have the right to report harassment without fear of retaliation, and employers are obligated to investigate and address such complaints (U.S.Equal Employement Oppertunity Commisision, n.d.). The laws apply to all types of work situations, including hiring, firing, promotions, harassment, training, wages, and benefits.

Many of the female employees have experienced sexual harassment at least once in their workplace. In Sri Lanka, sexual harassment is classified as a criminal offense. As a result, many cases of sexual harassment typically conclude with the provision of compensation to the victim and the imposition of fines on the perpetrator(SARAM, 2024).

Workplace harassment can have severe consequences for both employees and organizations. For individuals, effects may include:

Legal Costs: Companies may face lawsuits or legal actions resulting from harassment complaints, leading to significant financial repercussions

Essential strategies that create a harassment-free workplace

 

Establish a Clear Policy: Companies should develop a comprehensive anti-harassment policy outlining unacceptable behaviors, reporting procedures, and consequences for violations.

 

Promote Awareness and Training: Regular training sessions can help employees recognize harassment and understand their rights. This should include education on unconscious biases and cultural sensitivity.

 

Encourage Open Communication: Foster a culture where employees feel comfortable reporting harassment. Ensure there are multiple reporting channels—such as direct supervisors, HR, or anonymous hotlines.

 

Take Complaints Seriously: Investigate all reports of harassment promptly and thoroughly. This demonstrates a commitment to maintaining a respectful workplace.

 

Support Victims: Provide resources such as counseling and support groups for those affected by harassment. Additionally, organizations should ensure that employees are not retaliated against for reporting incidents.
